    2. the Privileged Service Recipient and the Service Provider agreed, or it clearly results from the circumstances of concluding the agreement for maintaining an Account, that a specific delivery date of the digital service was essential for the Privileged Service Recipient, and the Service Provider failed to deliver it within that time limit.

  8. In addition, if the digital service is not in conformity with the agreement for maintaining an Account, the Privileged Service Recipient may submit a statement of withdrawal from this agreement when:

  4. The Consumer may additionally use the free assistance of a municipal or district consumer ombudsman.

§ 6 RIGHT OF WITHDRAWAL FROM THE AGREEMENT

  1. The Privileged Service Recipient has the right to withdraw from the agreement for maintaining an Account concluded with the Service Provider, within 14 days without giving any reason.
  2. The withdrawal period for the agreement for maintaining an Account expires after 14 days from the date of conclusion of this agreement.
  3. In order for the Privileged Service Recipient to exercise the right of withdrawal, they must inform the Service Provider, using the contact details provided in § 2 of the Terms and Conditions, of their decision to withdraw from the agreement by an unequivocal statement (for example, a letter sent by post or by e-mail).
  4. The Privileged Service Recipient may use the model withdrawal form provided at the end of the Terms and Conditions, but it is not obligatory.
  5. To meet the withdrawal deadline, it is sufficient for the Privileged Service Recipient to send the communication concerning the exercise of their right of withdrawal before the withdrawal period has expired.

§ 7 PERSONAL DATA

  1. The Controller of personal data provided by the Service Recipient in connection with concluding the agreement for maintaining an Account is the Service Provider. Detailed information regarding the processing of personal data by the Service Provider – including other purposes and legal bases of data processing, as well as data recipients, can be found in the privacy policy available in the Store – pursuant to the transparency principle set forth in the General Data Protection Regulation (EU) – " GDPR".
  2. The purpose of processing the Service Recipient's data is the maintenance of the Account. The legal basis for processing personal data in this case is the agreement for maintaining an Account or steps taken at the request of the Service Recipient prior to entering into it (Article 6(1)(b) of the GDPR), as well as the legitimate interest of the Service Provider, consisting of data processing for the establishment, exercise, or defense of potential claims (Article 6(1)(f) of the GDPR).
  3. Providing data by the Service Recipient is voluntary, but at the same time necessary to conclude the agreement for maintaining an Account and to provide the services covered by it. Failure to provide data means that the agreement for maintaining an Account cannot be concluded and the Service Provider will not be able to provide the services covered by it.
  4. The Service Recipient's data will be processed until:
    1. the agreement for maintaining an Account ceases to be in effect;
    2. the possibility of pursuing claims by the Service Recipient or the Service Provider related to the Account expires;
    3. the Service Recipient's objection to the processing of their personal data is accepted – where the legal basis for processing was the legitimate interest of the Service Provider
    – whichever is applicable in the given case.
  5. The Service Recipient has the right to demand:
    1. access to their personal data,
    2. their rectification,
    3. erasure,
    4. restriction of processing,
    5. data portability to another controller as well as the right to:
    6. object at any time to the processing of data on grounds relating to the Service Recipient's particular situation – against the processing of personal data concerning them based on Article 6(1)(f) of the GDPR (i.e. on legitimate interests pursued by the Service Provider).
  6. In order to exercise their rights, the Service Recipient should contact the Service Provider.
  7. In the event that the Service Recipient considers that their data is being processed unlawfully, the Service Recipient may lodge a complaint with the authority competent for personal data protection. In Poland, this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).

§ 8 AMENDMENTS TO THE TERMS AND CONDITIONS OR THE ACCOUNT

  1. The Service Provider reserves the right to amend the Terms and Conditions only for valid reasons. A valid reason is understood as the necessity to change the Terms and Conditions caused by:
    1. a change in the functionality of the Account, requiring a modification of the Terms and Conditions, or
    2. a change in legal provisions affecting the performance of the agreement for maintaining an Account by the Service Provider or adapting the services to recommendations, guidelines, orders or prohibitions, judgments, rulings, interpretations, or decisions of authorized public authorities, or
    3. a change in the contact or identification details of the Service Provider.
  2. Information regarding the planned amendment to the Terms and Conditions will be sent to the Service Recipient's e-mail address assigned to the Account at least 7 days before the changes enter into force.
  3. In the event that the Service Recipient does not object to the planned changes prior to their effective date, they shall be deemed to have accepted them, which does not constitute any obstacle to terminating the agreement in the future.
  4. In the event of non-acceptance of the planned changes, the Service Recipient should send a notification thereof to the Service Provider's e-mail address specified in § 2 of the Terms and Conditions, which will result in the termination of the agreement for maintaining an Account upon the entry into force of the planned changes.
  5. The Service Provider may make an alteration to the Account that is not necessary to maintain its conformity with the agreement for maintaining an Account, for the reason specified in Section 1(b) or due to a change in the functionality of the Account. The introduction of the change referred to in the preceding sentence shall not entail any costs on the part of the Privileged Service Recipient. The provisions of Sections 2–4 shall apply accordingly.
  6. If the change referred to in Section 5 significantly and negatively impacts the Privileged Service Recipient's access to or use of the Account, the Service Provider shall send to the Privileged Service Recipient's e-mail address, reasonably in advance, on a durable medium, information regarding the characteristics and timing of such change as well as the rights granted to the Privileged Service Recipient in connection with that change.

§ 9 FINAL PROVISIONS

  1. The Service Recipient is prohibited from providing unlawful content.
  2. The agreement for maintaining an Account is concluded in the Polish language.
  3. The agreement concluded on the basis of these Terms and Conditions shall be governed by Polish law, subject to Section 4.
  4. The choice of Polish law for an agreement concluded on the basis of the Terms and Conditions with a Consumer does not waive or restrict the Consumer's rights granted under mandatory provisions of law applicable to the Consumer in the absence of a choice of law. In particular, this means that if the national provisions applicable to a given Consumer provide broader protection than that arising from these Terms and Conditions or Polish law, such broader protection shall apply.
  5. In the event of any dispute with a Service Recipient who is not a Privileged Service Recipient, arising in connection with the agreement for maintaining an Account, the court having jurisdiction shall be the court competent for the Service Provider's registered office.

  2. The purpose of processing the Service Recipient's data is:

    • analysis of the effectiveness of messages sent under the Agreement, in order to establish general rules regarding effective mailings in the Service Provider's business; the legal basis for processing personal data for this purpose is the legitimate interest of the Service Provider (Article 6 (1)(f) of the GDPR);

  3. Providing data by the Service Recipient is voluntary, but at the same time necessary to conclude the Agreement and provide the digital content covered by it. Failure to provide data will result in the inability to conclude the Agreement, and the Service Provider will not deliver the digital content covered by it.
  4. The Service Recipient's data will be processed until:
    1. the Agreement ceases to be in effect;
    2. the possibility of pursuing claims by the Service Recipient or the Service Provider related to the Agreement expires;
    3. the Service Recipient's objection to the processing of their personal data is accepted – where the legal basis for processing was the legitimate interest of the Service Provider
    – whichever is applicable in the given case.
  5. The Service Recipient has the right to demand:
    1. access to their personal data,
    2. their rectification,
    3. erasure,

  6. In order to exercise their rights, the Service Recipient should contact the Service Provider.

In the event that the Service Recipient considers that their data is being processed unlawfully, the Service Recipient may lodge a complaint with the authority competent for personal data protection. In Poland, this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).

§ 8 AMENDMENTS TO THE TERMS AND CONDITIONS OR THE NEWSLETTER

  1. The Service Provider reserves the right to amend the Terms and Conditions only for valid reasons. A valid reason is understood as the necessity to change the Terms and Conditions caused by:
    1. a change in the functionality of the Newsletter, requiring a modification of the Terms and Conditions, or
    2. a change in legal provisions affecting the performance of the Agreement by the Service Provider or adapting the services to recommendations, guidelines, orders or prohibitions, judgments, rulings, interpretations, or decisions of authorized public authorities, or

  2. Information regarding the planned amendment to the Terms and Conditions will be sent to the Service Recipient's e-mail address provided at the time of concluding the Agreement at least 7 days before the changes enter into force.
  3. In the event that the Service Recipient does not object to the planned changes prior to their entry into force, they shall be deemed to have accepted them, which does not constitute any obstacle to terminating the Agreement in the future.
  4. In the event of non-acceptance of the planned changes, the Service Recipient should send a notification thereof to the Service Provider's e-mail address specified in § 2 of the Terms and Conditions, which will result in the termination of the Agreement upon the entry into force of the planned changes.
  5. The Service Provider may make an alteration to the Newsletter that is not necessary to maintain its conformity with the Agreement, for the reason specified in Section 1(b) or due to a change in the functionality of the Newsletter. The introduction of the change referred to in the preceding sentence shall not entail any costs on the part of the Privileged Service Recipient. The provisions of Sections 2–4 shall apply accordingly.
  6. If the change referred to in the preceding provision significantly and negatively impacts the Privileged Service Recipient's access to or use of the Newsletter, the Service Provider shall send to the Privileged Service Recipient's e-mail address, reasonably in advance, on a durable medium, information regarding the characteristics and timing of such change as well as the rights granted to the Privileged Service Recipient in connection with that change.

  3. The Agreement concluded on the basis of these Terms and Conditions shall be governed by Polish law, subject to Section 4.
  4. The choice of Polish law for the Agreement concluded on the basis of the Terms and Conditions with a Consumer does not waive or restrict the Consumer's rights granted under mandatory provisions of law applicable to that Consumer in the situation in which no choice of law takes place. In particular, this means that if the national provisions applicable to a given Consumer provide broader protection than that arising from these Terms and Conditions or Polish law, such broader protection shall apply.
  5. In the event of any dispute with a Service Recipient who is not a Privileged Service Recipient, arising in connection with the Agreement, the court having jurisdiction shall be the court competent for the Service Provider's registered office.
